Over recent times we have been involved with several strata title matters ranging from drafting strata plan management statements, arranging new titles for strata plan sub-divisions, advising developer in strata plan developments and representing strata owners in the District Court. Kasta Nominees Pty Ltd v O’Connor [No2] [2017] WADC 3 is a recent case where we successfully represented strata owners concerning a re-subdivision application under Section 51 of the Strata Titles Act (1985) (“the Act”). We think this case is worth noting as reported Court decisions on the application of the Act don’t occur frequently.

The Act is also due to undergo some significant reforms to address the evolving nature of strata title developments in Western Australia. Under the State Government’s direction, Landgate has recently identified five key reform areas to the Act which include:

• new forms of strata;

• buyer information and protection;

• resolving strata disputes;

• management of strata schemes; and

• termination of strata schemes.

 

These reforms are anticipated to be introduced into Parliament this year. While these reforms are not law yet, they are worth keeping in mind for the future.
