What is a letter of demand?
A letter of demand is a demand for payment which confirms: the amount of the debt; the debt is outstanding; and a timeframe for payment.
Can I issue a letter of demand myself?
You can but in our experience, debtors take more notice if the letter of demand is issued by a creditor’s legal representative.
Do I need to instruct a debt collector to recover my debt?
No, you can instruct a lawyer directly to act on your behalf to recover the debt(s).
What is the difference between a letter of demand and statutory demand?
A letter of demand is letter demanding payment to any debtor. A statutory demand is a demand made by a creditor to a debtor company which is issued under the Corporations Act 2001 (Cth) and must be in the prescribed form.
Do statutory demands have a minimum debt amount?
Yes, the debt must be at least $4,000.
Can I recover a debt even if I don’t have any paperwork?
Having written evidence as to how the debt was incurred is very helpful but it is not mandatory. Depending on the circumstances, you may be able to recovery your debt without any paperwork.
Which WA courts are used for debt recovery?
The type court used for debt recovery will depend on the amount being claimed. For debts less than $75,000 these matters are heard in the Magistrates Court of Western Australia. The District Court of Western Australia deals with debts between $75,001 and $750,000. The Supreme Court of Western Australia deals with debt recovery matters over $750,001.
