Appeals Lodged by BGC in the Supreme Court Court of Appeal
The BGC defendants have lodged appeals in the Supreme Court of Western Australia Court of
Appeal appealing the decision of Justice Gething made 21 April 2026 in the Supreme Court of
Western Australia (Decision). We have filed notices in the Court of Appeal on behalf of the class
action plaintiffs to take part in the appeals and will keep you updated regarding further appeal
programming orders when they are made.
Notwithstanding the appeals to the Decision, we are continuing with our preparations for the Strategic
Conference to be held on Friday, 5 June 2026 in the Supreme Court. Any group members wishing to
attend the Strategic Conference are welcome to do so. We ask that if any group members are
intending to attend the Strategic Conference, they notify us by email to
inform the Court of likely attendee numbers.
